Acceptance:

Acceptance of any costing should be provided in writing by a client.

 

Where a PO is issued by the client as SOP, work shall not begin until receipt of this PO.

Upon acceptance of a cost estimate, the client shall be deemed to have accepted these terms of service.

 

Shoot Cancellation:

Where a shoot is booked and confirmed by the client, cancellation of 50% of shoot related line items shall be due if the shoot is cancelled with less than 48 hours notice of the planned shooting day or period. 

 

Where a shoot is cancelled with less than 24 hours notice, 100% of shoot-related line items shall be due. The producer shall always endeavour to reduce cancellation fees as best as possible through crew and equipment supplier negotiation, but reserves the right to charge as indicated should these suppliers not be able waiver their fees.

 

Shoot Duration:

A half day shoot is defined as any shooting period of 5 hours or less, exlcluding transport, setup and breakdown time. Half day shoots are typically charged at 75% of daily rate.

 

Travel days are defined as any period of up to 24 hours where a crew is in transit but not shooting. Travel days are typically charged at 50% of daily rate.

 

A full day shoot is defined as any shooting period of more than 5 hours but less than 10 hours.

 

Where a half day shoot continues beyond the maximum 5 hour period through no performance or operational challenges by the producer (for example, an interviewee being late for an appointment), the shoot shall be converted to a full day and the client shall be liable for the additional 25% of day rate on all shoot-related line items.

 

Where a full day shoot continues beyond the maximum 10 hour period through no performance or operational challenges by the producer, overtime shall be charged at 1.5x the prorata hourly rate for all shoot-related line items rounded up to the nearest hour of overtime worked.

 

The producer shall always verbally inform a client as soon as possible should a scoped half day, travel day or full day be at risk of changing to a full day or overtime charge.

 

Ownership:

All scoped deliverables shall remain the property of the producer until full payment is received. 

 

Where working files or raw footage is not specifically itemised in a costing or scope, these shall remain the property of the producer, with release of same subject to a further costing.

 

Liability:

Where content is supplied by or on instruction of the client to the producer for inclusion in production of any deliverable, the client assumes all liability relating to the usage rights and licensing of said material.

 

Where content is used in a deliverable for the client by the producer, the producer guarantees the usage rights and licensing of said material, for the specific duration and destination scoped for the content ONLY.

 

Should a client utilise a deliverable on a destination platform not scoped, or for a duration not scoped, the client assumes all liability for licensing renewal or additional fees related to the usage.
